两年前,我在AbuDhabi租了一栋别墅。预计会在里面居住至少五年以上,故花了很多钱来装修,保养。然而,我在房地产办公室办理为期两年的租赁合同手续时,对方向我保证,以后的租金不会增加,同等条件下每两年后更新签订一份租赁合同续租即可。这是一个口头上的承诺,而不是一个书面协议。一个月前,房地产公司经理来信通知我说:“业主想要拆除并重建别墅。要求我在房屋租赁合同今年10月底到期时搬离。”因别墅保养良好,我认为对方并无更新租赁合同的意愿。根据阿联酋法律租赁法我有哪些法律追索权?

如遇拆迁,阿布扎比租赁法要求房东遵守第6段第23条规定。第一,该房地至少15年前已建成。其次,房东需要通过主管部门允许以获得必要的拆迁权限。因此,提问者可以回绝房东的要求,并给地产办公室发回信寻求更新续租合同。如果房东或房地产公司代理人不予响应也不续签合同。那么提问者应向所设委员会提起申诉以调查解决租金纠纷问题。

Twoyearsago,IrentedavillainAbuDhabiforfamilyuse.IspentalotofmoneyondecorationandmaintenanceontheassumptionthatIwouldliveinthevillaforatleastfiveyears.However,IsignedatenancycontractfortwoyearsaftertherealestateofficeIwasdealingwithassuredmethattherentwillnotbeincreasedandthecontractwillberenewedforanothertwoyearsonthesameconditions.Thiswasaverbalunderstandingandnotawrittenagreement.Onemonthago,themanageroftherealestateofficesentmealetterinformingmethattheownerdesirestodemolishandrebuildthevilla.Theletterrequestedmetovacatethepremisesattheendofmyrentalcontract,whichexpiresthisOctober.Asthevillaisingoodcondition,Iassumethattheyhavenodesiretorenewthecontract.WhatlegalrecoursedoIhaveundertheUAErentallaw?  

Incaseofdemolition,theRentalLawinAbuDhabiobligesthelandlordtofollowcertainconditionsstipulatedinclause23,paragraph6.First,thepremisesshallhavebeenconstructedatleast15yearsago.Second,thelandlordneedstoobtainnecessarypermissionsbythecompetentauthoritiesforthepurposeofdemolition.Therefore,thequestionermayrejectthelandlord’srequest,andsendtherealestateofficealetterseekingrenewalofthetenancycontract.Ifthelandlordorhisrepresentativerealestateofficedonotrespondandrenewthecontract,thequestionershouldfileacomplaintbeforethecommitteeestablishedtolookintorentdisputes.

Ihaveworkedasasalesmanagerinacompanyformorethanfiveyearsonanunlimitedlabourcontract.Mycompensationpackageincludessalaryandotherentitlements.Twomonthsago,theemployersoldthecompanyalthoughitwasdoinggoodbusinessandmakingprofits.Myproblemstartedwhenthenewemployeraskedmetomovetoanotherbranchofthecompanywithachangeinjobdescription.ThenewpositionwasadowngradeandIalsohadtotakeasalarycut.Isubmittedmyresignationaftergivingone-monthnoticetothecompany.Ontheexpiryofthenoticeperiod,Iaskedthecompanytosettlemyend-of-serviceentitlements,butthenewemployersrejectedmyrequest.HeclaimedthathewasnotobligedtosettlemyduesfortheperiodthatIwasworkingwithmypreviousemployer.Heclaimedthattheyagreedinthesaleagreementthatthepreviousemployerwilltakefullresponsibilityforpayingtheduesofemployeesashesignedthelabourcontracts.Thenewemployerwillonlyholdresponsibilityfornewemployees.HowshouldIobtainmyentitlements?WhoisresponsibleformyentitlementsasperUAElabourlaw,thepreviousornewemployer?

Article126oftheUAELabourLawstates:“Whereachangeoccursintheformorlegalstatusoftheestablishment,contractsofemploymentthatarevalidatthetimeofthechangeshallremaininforcebetweenthenewemployerandtheworkersoftheestablishment,andtheirserviceshallbedeemedtobecontinuous.Boththeoriginalemployerandthenewemployershallbejointlyliableforaperiodofsixmonthsforthedischargeofanyobligationsresultingfromcontractsofemploymentduringtheperiodprecedingthechange;aftertheexpiryofthisperiodthenewemployershallsolelybearliability.”
